1. Agreement to Terms

By accessing our services and engaging Engineering Solutions for custom software implementation, you agree to be bound by these Terms and Conditions. Our services primarily involve the implementation, customization, hosting, and support of open-source technologies (such as ERPNext, Frappe, Chatwoot, and evolution-api).

2. Open Source Licenses

Engineering Solutions utilizes various open-source software platforms. The underlying source code of these platforms remains governed by their respective open-source licenses (e.g., GNU GPLv3 for ERPNext, MIT for Frappe). You are granted the rights to use the software strictly under the terms of these original licenses.

3. Custom Code & Intellectual Property

Any custom integrations, proprietary scripts, custom applications, or AI bridging models developed specifically by Engineering Solutions for your business remain the intellectual property of Engineering Solutions unless explicitly stated otherwise in a separate Service Level Agreement (SLA) or contract. Upon full payment of deployment fees, you are granted a non-exclusive, non-transferable license to use these custom integrations within your organization.

4. Hosting and Data Access

If you utilize our cloud-hosted infrastructure (e.g., via Cloudflare tunnels and our local servers), you remain the sole owner of all business data entered into the system. Engineering Solutions acts only as a data processor. We maintain routine automated backups (e.g., via rclone to cloud providers), but we are not liable for data loss caused by factors outside our control.

5. Third-Party Integrations

Our solutions may interface with third-party services (e.g., WhatsApp Business API, OpenAI/Gemini APIs). You agree to comply with the terms of service of these respective providers. Engineering Solutions is not responsible for any service interruptions, API changes, or account suspensions initiated by these third-party providers.

6. Limitation of Liability

In no event shall Engineering Solutions be liable for any indirect, incidental, special, or consequential damages, including loss of profits, revenue, data, or use, incurred by you or any third party, whether in an action in contract or tort, arising from your access to, or use of, our implementations and services.
